Robert Kingett<p>Had an instance where I was denied an Uber ride because of my white cane. Lyft too! I eventually had to use UZURV to get me home. For those not in the know, UZURV is an on demand ride share specifically designed for Disabled people and my city covers the costs of these rides via the Paratransit partnerships with UZURV. I had booked a ride to go from the library to my home. Each time, on each service, the driver pulled up just enough to see me, see my cane, then pull away. Both apps said my trips were canceled. I logged the incident and complained to both Uber and Lyft. I got ride credits from Lyft, which tells me they are well aware this is happening and have some internal mechanism to deal with things like this, which tells me they aren't doing enough. They are doing enough just to make the problem go away. Radio silence from Uber. Not every state has a Paratransit partnership with UZURV and I don't know about other countries, but I think UZURV is a United States only thing. These tech companies need to be held accountable. I just received the following message via the Uber app.<br>Hi Jonathan‍,<br>My name’s (name redacted), from the Community Operations team. I appreciate your patience regarding this matter, and apologise for the delay in getting back to you.<br>Thanks for letting us know about this incident, and I’m sorry to hear about your experience.<br>We are very sorry to hear that you are continuing to experience issues regarding service refusal in relation to your Service Animal. I would like to reassure you that Uber takes complaints of this nature seriously as discrimination from anyone using the Uber app is not tolerated.<br>I would like to share the general process we follow in these circumstances with you again so that you have it for future reference.<br>If this report is the driver-partner’s first report, we immediately remove access to the Uber app until they complete the following:<br>- Watch a video and complete a test created by Be Accessible<br>- Acknowledge they have read and understood the Uber Community Guidelines as well as the Human Rights Act 1993<br>If this is their second confirmed report, we will generally remove their access to the Uber app permanently.<br>We have completely refunded any fees associated with this concern. Please allow 5-10 business days for this to be reflected in your bank account. In addition to the refund provided, we have issued $35 Uber Cash for use on your Uber account.<br>We appreciate your ongoing assistance and patience on this matter, and we will be sure to look into any feedback that you may have.<br>Again, I’m very sorry to hear about this and we hope you’ll continue to let us know if you experience further issues in the future. You can always get in touch through the “Help” section of the app. We are here to help.</p><p>I responded as follows.<br>Hello (name redacted), thank you for this response, for the refund and credit. <br>On this occasion I am not satisfied and do not consider this matter closed. Something is clearly faulty with Uber's driver training.<br>Since Uber operates in New Zealand, it is obliged to ensure that its drivers are fully aware of the law and obey it. These refusals are happening too often for there to be any doubt that whatever Uber is doing now, it is insufficient.<br>Accordingly, I have lodged a formal complaint with the New Zealand Transport Agency, the regulator here in New Zealand, asking them to open an investigation into Uber’s shortcomings when it comes to acquainting drivers with the law.<br>While I am not willing to speak with frontline Uber support people on this matter, I would be prepared to speak with someone at management level about how this situation might be improved and resolved. Otherwise, I will advocate strongly for the NZTA to take decisive, and clearly long overdue action. Uber can not be allowed to go on like this. Jonathan Mosen<p>There is a global need for us to stand up for our <a href="https://caneandable.social/tags/RightToRide" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>RightToRide</span></a>. Here is a message I just sent to Uber, which explains what we just went through tonight. </p><p>I am blind and use a white cane. My wife is also blind and is accompanied by a guide dog.<br>This evening, we enjoyed dinner with friends, and upon leaving the restaurant, used the Uber app to request a ride home.<br>The driver pulled up almost immediately, but I still sent a text to him to let him know that my wife and I are blind and that she was traveling with a guide dog. I asked the driver if he could assist us to his vehicle.<br>One of my friends has some useable vision, and was able to direct us to the vehicle. The driver told my friend that he wasn’t going to take us and that we had to call Uber pet. All of us explained calmly and clearly that guide dogs were not pets, that it was illegal for him to refuse to carry us.<br>The driver did not believe us. He kept insisting we must use Uber Pet, or Uber Assist. At this point, I explained the process as I understood it. That if he drove away in breach of the law, we would notify Uber. Uber would begin an investigation which would result in the driver being barred from the platform pending that investigation, and possible further training.<br>At this point, I was videoing the exchange on my phone for evidence, which I may yet still provide to the media. The driver continued to insist that he wasn’t required to transport us. I indicated that since he was breaking the law, we also had the option to call the police.<br>As I am tired of having my civil rights violated by Uber drivers in this way, I calmly advised the driver that I was going to sit in the vehicle while my friends called the police. I explained that while in it, I would also seek to raise assistance from someone at Uber.<br>At this point, he said, “OK, I’ll take you”. I didn’t feel particularly safe, but I advised my wife that we were no longer being refused a ride and that she should get into the back of the vehicle with her guide dog.<br>During the ride home, the driver was courteous and I think curious, but he continued to insist that he wasn’t required to take us, that he was only doing so out of sympathy for us because we are blind. I took the opportunity to educate, to explain how well trained guide dogs are. He asked what functions guide dogs performed and we explained them to him. But he kept insisting that Uber had told him that disabled people with dogs should use Uber Assist or Uber Pet. For the record, we used Uber X because a driver was nearby and it was raining heavily.<br>To add insult to injury, because of the altercation which took several minutes, we have been charged extra for the ordeal we endured.<br>Clearly, something is seriously deficient in terms of the way Uber trains and onboards its drivers. Blind people should not be made to feel like they are liars, and have to take action to prevent the vehicle from leaving the scene so the police can get involved, just to get home from a night out.<br>Drivers must know the law, and Uber must take responsibility for ensuring drivers are aware of the law and comply with it.<br>This was a deeply distressing, upsetting conclusion to what was a pleasant night. We should be able to enjoy a night out without it ending like this.</p>
